John William Prentice of Australia
By Linus Joseph Dewald Jr., Editor
Spring 2011 and Revised 9 Apr 2015

We found the following family at Ancestry.com . If you have any information about the folks mentioned in this article, please send your information to us at the Prentice Newsletter. Be sure to give the full title and date of this article in the Subject line of the email.

    A. (perhaps) Martin Prentice and Mary Graham, perhaps b. c. 1780-1800, England.

The names of Martin Prentice and Mary Graham come from Dianne Allan's email of 30 Jun 2014 which reads as follows:

"I'm not positive about his parents, but in Queensland BDM [#1 John William Prentice] died 1866 and [BMD] says his parents were Martin Prentice & Mary Graham but it doesn't say where [John died and Dianne has not ] applied for the certicate. {Dianne says] they came from Warwick [Australia], but unless you can find out if this is where he died I'm not sure if I have his parents' names correct.

If the parents [Martin and Mary] are correct he would have been born in Halstead, Essex. Eng. I do know that #1(iv) John, b. 1861 served in the Australian Imperial Force ( Remounts ) in 1915. I hope you can find out more if his parents are correct, . . Their are no other death reports for #1 , John William Prentice, 1867 to 1874."

Perhaps son of Martin and Mary:

    1. John William Prentice, b. c. 1820-1932. . . . . . . . . . . . . . . . . . . . . . . . . . . . [1]

    1. John William Prentice may have been b. c. 1828, perhaps in the Parish of Bocking, which is a part of the town of Braintree, Essex. He was living there at the time of his conviction for theft in 1848. He d. 1866, Australia. By 1861 he was living in Australia where his son, John, was born. The following material comes from Lester Jackson's email of 7 Apr 2015.

John Prentice's conviction (second occasion) on 4 January 1848 states that he was from the Parish of Bocking, which is a part of the town of Braintree, Essex. In The Chelmsford Chronicle of 14 January 1848 the details of the case were recorded. His age was stated as being 19 years, which would most likely be 19 years in 1847 taking into account that the trial was very early on January 1848. This would put his birth date as 1828. John Prentice's (Junior) Birth Certificate states that his father was 31 years old when he was born on 28 January 1861, which would put his fathers birth date at 1829 or 1830 if his father's birthday was in January.

The UK Prison Hulk Registers and Letter books 1802-1849 show a John Prentice was imprisoned in the hulk "Portland" in Langstone Harbour, Portsmouth in 1849.

The Ticket of Leave and the Ticket of Leave Passport state that John Prentice (Senior) was transported to Australia on the sailing ship Mount Stuart Elphinstone in 1849 following a trial on 4 January 1848 where he was convicted of larceny (with a previous conviction for felony) and sentenced to 7 years transportation.

On the Roots UK.com website there are 15 John Prentices registered as having been born in Essex at the 1841 census. There are only 3 in contention born in 1827, 1828 and 1830: (1) The John Prentice born in 1827 was born in Markets Tey, which is a village about 14 km east of Braintree. (2) he 2ndthird John Prentice born in 1830 lived in Chelmsford, which is about 18 km south of Braintree. (3)The one born in 1828 lived in Cressing in 1841 (when he was 13 years), which is situated about 4.5 km east of Braintree.

At John Prentice first court appearance in 1847 there was a James Owens from the Parish of Bocking (the same as John Prentice) who was a co-accused. There is a person by this name who lived in Braintree in 1841 who would have been 17 years old at the time of the trial when John Prentice was 18 years old. This makes (2) John Prentice, born in 1828 and lived in the Braintree, Bocking, Cressing area, (similar to his co-accused James Owens), a strong contender as the father of John Prentice Jr. Lester Jackson's email of 7 Apr 2015 suggests he is the John Prentice, b. c. 1828, who is the son of Francis Prentice, #2(i)(a) in our Summer 2002 article about the Prentices of Cressing, Essex, England .

Lester Jackson has copies of John Prentice's (Senior) Ticket of Leave dated 30 November 1849 and his Ticket of Leave Passport dated 16 June 1850 that allowed him to remain in the service of G.R. Gore on the Darling Downs for a period of 12 months. The Marriage Certificate gives their address as Budumba Station, which was owned by Gore.

John m. Johanna Cotton Landry on 26 Sep 1854 in the Church of England, OJ District, Drayton, Toowoomba, Queensland, Australia (per IGI). She was b. in Ireland and d. 1869.

Lester Jackson has the marriage certificate of John Prentice (Senior) to Johanna Cotton Landey in 1854 that is authorised by the Governor General. Persons serving a prison term at this time required the marriage to be authorized by the Governor of the colony. In this case the authority was from the Governor general. We have records to show that the marriage took place at the Court House, Warwick within the Parish of Drayton.

All of John Prentice and Johanna Cotton Landey’ s children I have listed were born in Queensland, Australia. Warwick is in Queensland. The first three however have both a Queensland Index and NSW index reference number which means you can get a copy of the certificate from either the Queensland State Registry or the NSW Registry. This is because before the formal separation of the States the Colony of NSW held many of the records. I understand that these were separated out in formation of each State register of BDM’s but the NSW register still shows the early registered events. I have read an article on this somewhere, will try and track in down for you. The place where they married, that is at the Church of England, Drayton, Toowoomba is also in Queensland.
